Waiver
Before you begin using our facilities, and/or participate in any outdoor trainings it is important that you understand and agree to our Terms and Conditions. This agreement outlines your rights and responsibilities, as well as those of Premier Performance LLC, ensuring a safe and enjoyable environment for everyone.
1. Client Physical Condition
By agreeing to these terms, you declare that you are physically fit and have no medical condition that would prevent your participation in physical exercise. You agree to inform Premier Performance LLC and its staff of any medical conditions, injuries, or other physical limitations before engaging in any activity. Participation in any activity is at your own risk, and you should consult a healthcare provider if you have concerns regarding your physical condition.
2. Assumption of Risk
You acknowledge that the use of Premier Performance LLC's facilities, including outdoor field or training space, involves risks of injury, including but not limited to musculoskeletal injury, cardiovascular overexertion, and others. By agreeing to these terms, you assume full responsibility for any and all injuries, losses, or damages that you may incur while using the facility, outdoor field or training space.
3. Waiver and Release of Liability
You hereby waive, release, and forever discharge Premier Performance LLC, its owners, officers, employees, and agents from any and all claims, demands, damages, rights of action, or causes of action, present or future, arising out of or connected with your use of Premier Performance's facilities or any and all services, including any injuries, loss, or damage suffered as a result of the negligence of Premier Performance LLC or its staff.
4. Entire Agreement; Choice of Law
This agreement constitutes the entire agreement between you and Premier Performance LLC and supersedes all prior or contemporaneous agreements, promises, or understandings, whether written or oral. This agreement shall be governed by and construed in accordance with the laws of the State of Virginia, without giving effect to any choice or conflict of law provision or rule.
5. Photo and Video Disclaimer
Premier Performance LLC reserves the right to photograph and videotape the facilities, including outdoor field or training space, and anyone present within for marketing and promotional purposes. By entering Premier Performance LLC's training space, you consent to the use of your image and likeness in such materials without compensation, and you release Premier Performance LLC from any liability related to the use of such images and videos.
